ORCA IQ

Terms of Use

Last updated: 18 September 2026

1. Who you are agreeing with

ORCA IQ and Train with Orca are operated by Orca Recruiter Systems Limited, registered in England and Wales, company number 17259799, registered office 11 Penfolds Place, Arundel, England, BN18 9SA.

2. What these terms cover

Your use of trainwithorca.com and of the ORCA IQ platform. If your employer has a signed agreement with us, that agreement wins wherever the two disagree. These terms are not the customer contract: pricing, service levels, data processing and liability between us and a client are set out in the client's signed agreement.

3. Accounts

Accounts are issued by your employer, not bought individually. Keep your login to yourself, and tell us if you think someone else has it. Your employer can create, suspend and remove accounts, and can see the activity of the people in its organisation. That is what the product is for.

4. What you may not do

Do not try to break in, do not attempt to reach another organisation's data, do not scrape or copy the platform wholesale, do not resell access, do not upload anything unlawful, and do not use it to harass anyone.

One that is specific to this product: do not upload a recording of a call you had no right to record. Whether a call may be recorded, and what the people on it must be told, is your organisation's responsibility and it varies by country. We give you the tools; we are not the ones on the call.

5. Recording, and telling people about it

Where your organisation captures calls through ORCA IQ, your organisation is responsible for the lawful basis and for the notices given to consultants and to the people they call.

6. Automated assessment

Calls are scored by AI against a coaching framework. Scores are a coaching aid for a human manager. Do not use ORCA IQ scores as the sole basis for a decision about someone's employment: hiring, dismissal, discipline, promotion or pay. A human must make those decisions with the full picture, and in many places the law requires exactly that.

7. Your content, and ours

Your organisation's calls, transcripts and the coaching records derived from them remain your organisation's. You grant us the licence we need to host, process and analyse them in order to provide the service. We do not use them to train AI models.

The platform, the coaching frameworks, the scenario library and the scoring methodology belong to Orca Recruiter Systems Limited or its licensors.

8. Availability

We work to keep the service running but do not promise uninterrupted service here. Any uptime commitment lives in your organisation's agreement, not on this page.

9. Ending it

Your employer can close accounts at any time. When a client's contract ends, that client's data is handled as set out in its agreement with us and in our Privacy Policy, which says we delete a client's call data within 90 days of the contract ending.

10. Liability

For clients, liability between us is set out in the client's signed agreement. For anyone else using this website, it is provided as it is, and to the extent the law allows we are not liable for loss arising from reliance on it.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

11. Governing law

The laws of England and Wales, with the courts of England and Wales having exclusive jurisdiction.

12. Changes

We will post changes here and, where they matter, tell clients directly.
